In the summer of 2010, the Director of Community Services tabled Report DCS 01/10 which provided a summary

of various reports that have been undertaken since 2004 with respect to the treatment of Southeast

Leamington.

Matters highlighted in the Director’s report included but were not limited to:

  • Sustainable Management Strategy for Leamington (May 2007)

  • East Marsh Drainage Scheme Dyke Assessment Report (November 2008)

  • Concession Road B & C Improvements (November 2008)

  • Point Pelee Peninsula Eastern Shoreline Erosion Mitigation Study (PPPESEMS) (April 2010)

  • Concept E: A Hybrid Solution (September 2009) An addendum (March 2010)

  • Colchester to South Shoal Sentiment Management Study (May 2010)

  • Federal Government Comments to date

  • Provincial Government Comments to date

  • Southeast Leamington’s Stakeholders Committee and Water Quality Issues

The Director’s report also contained a high level overview of cost estimates as it relates to various proposals

outlined in the studies and further provided a magnitude of the financial impact on the Municipality of Leamington

landowners and other levels of government.

In summary, the report provided two suggested options for Leamington Council to consider which were:

Option 1

Maintaining the status quo land use of the Official Plan (which would include maintaining the infrastructure in the

area); or

Option 2

Supporting a significant change in land use such as open space or managed wetlands (naturalize the area).


As a result of the Director’s report, Council sought input from stakeholders in the area and further asked for

comments from the public.

After receiving comments from stakeholders and the public, Council at its meeting held October 18, 2010

enacted the following resolutions:

No. C-391-10

That council adopt Option 1 as contained in DCS 01/10 dated June 25, 2010 re: S/E

Leamington Sustainability – Summary Report, which reads as follows:

That Council confirm its existing land use policies for the South East Leamington Study Area

as contained in Leamington’s Official Plan (By-law 794-07);

And that Council confirm its commitment that the study area is sustainable for continued

agricultural and residential use;

 

And that Council authorize Administration to report back with recommended terms of

references, time lines, consultants, study cost estimates and funding options for the projects

identified for Council approval prior to 2011 budget deliberations, for the following:

  1. Engineering reports under the Drainage Act for:

  • repairs and improvements to the East Marsh Dyke, (Assessment Report - Nov 2008)
  • repairs and protection of the Marentette Drainage Scheme (PPPESEMS - April 2010)
  • repairs and protection of the Lloyd Drainage Scheme (PPPESEMS - April 2010)
  • Environmental Assessment process for Road C (similar to Road B & C report - Nov 2008)

And that Council request Administration to report back with details concerning the process

required for the design and construction of a cobblestone berm in Lake Erie from Wheatley

Harbour to Point Pelee National Park, including jurisdictional and financial responsibilities;

And that Council endorse the concept of a willing seller and willing buyer in the Southeast

Leamington Area;

And that Council coordinate a meeting with the Minister of Natural Resources to review

Section 28 of the Conservation Act as it pertains to Southeast Leamington;

And that Council petition the Federal Government and National Park to build the necessary

structures at the northeast corner of the park to protect its shoreline in that area from further

erosion;

            

              And that Council petition the Provincial Government and the Essex Region Conservation Authority

              to repair the Hillman Dyke where it has been damaged by wave action from the Hillman Marsh;

And that Leamington Council endorses the following short-term goals:
 
    • Wheatley Harbour sand bypassing;

    • Annual sand nourishment

 

 No. C-390-10

That the short term and long term initiatives identified by the Southeast Leamington

Stakeholders’ Committee, as noted below, be included in the motion:

And that Council petition the Federal Government and National Park to build the necessary

structures at the northeast corner of the park to protect its shoreline in that area from further

erosion;

 

And that Council petition the Provincial Government and the Essex Region Conservation

Authority to repair the Hillman Dyke where it has been damaged by wave action from the

That the following amendments be made to the notice of motion:

That paragraph three (3) of read as follows:

“And that Council authorize Administration to report back

with recommended terms of references, time lines,

consultants, study cost estimates and funding options for

the projects identified for Council approval prior to 2011

budget deliberations, for the following:…”

And that Council endorse the concept of a willing seller

and willing buyer in the Southeast Leamington area;

And that Council coordinate a meeting with the Minister of

Natural Resources to review Section 28 of the

Conservation Act as it pertains to Southeast Leamington.
