Council Matters - December 8, 2020

At the Council meeting on December 8, 2020 at 6:00 PM, Leamington Council:

  • Received the results of the public consultation on Greenhouse Lights and directed Administration to bring forward an amended Greenhouse Light Abatement By-law, which was passed at the meetingA copy of the By-law can be found at leamington.ca/meetings.

The by-law includes an option to turn lights off rather than install and close curtains, as well as the following provisions:

1. In connection with the Requirements for Greenhouse Curtains (formerly section 5 of draft By-law 79-20):

An owner of a greenhouse shall ensure that:

 (a)   Curtains are closed completely on greenhouse sidewalls and endwalls from one hour before sunset until one hour after sunrise;

 (b)   Curtains are closed completely on a greenhouse ceiling from one hour before sunset until one hour after sunrise; except between the hours of 2:00 AM and 6:00 AM during which time ceiling curtains must be at least ninety percent (90%) closed, sunrise and sunset being determined by the National Research Council Canada’s sunrise/sunset calculator.

2. In connection with the Effective Date to have sidewall and endwall curtains installed and closed in accordance with the provisions of the By-law (formerly section 12 of draft  By-law 79-20):

Provision to take effect and come into force on April 1, 2021.

3. In connection with the Effective Date to have ceiling curtains installed and closed in accordance with the provisions of the By-law (currently section 13 of draft By-law 79-20):

Provision to take effect and come into force on October 1, 2021.

4. As an interim measure pending the coming into force of the requirements for sidewall, endwall and ceiling curtains to be installed and closed, include the following new  provision which shall take effect and come into force on January 1, 2021:

An owner of a greenhouse that utilizes lights shall ensure that lights are turned off between the hours of 8:00 PM and 2:00 AM unless the owner can comply and does comply with the requirements for greenhouse curtains as set out in the By-law.   

  • Assumed the sidewalk construction within the Saad (Southwinds) Phase 1 subdivision.
  • Received a report on the 2020 Open and Closed Council Meetings and approved the proposed 2021 Council Meeting schedule.
  • Council, at its meeting held November 24, 2020 declared the office of a member of Council vacant due to the passing of Councillor John Jacobs. Council appointed Trevor Jones to the office of member of Council.
  • Appointed Councillor Tiessen and Councillor Wilkinson as Council representatives to the Leamington Committee of Adjustment for a term to expire December 31, 2021.
  • Approved a by-law to provide for the 2021 interim tax levy in the Municipality of Leamington. The Municipality of Leamington includes the following types of taxes and rent charges in the calculation of the interim tax levy:
    • Municipal levy
    • County levy
    • School purposes levy
    • Business improvement area (BIA) levy
    • Uptown parking levy and;
    • Garbage levy
  • Approved a by-law to provide for the 2021 borrowing limit for the Municipality of Leamington. The borrowing by-law is presented to Council each year to establish the borrowing limits for the Municipality. For several years the borrowing request has been $20,000,000, and in the form of a line of credit. No lines of credit have been used in recent years to fund current obligations and at the present time, there are no plans to borrow.
