    Election Campaign Period 

    The day a candidate files their nomination for office is when their election campaign period begins.  Their campaign period ends on December 31, 2018.  A contribution shall not be made to or accepted by or on behalf of a person unless he or she is a candidate.

    Applying for a Compliance Audit

    An elector who is entitled to vote in an election and believes on reasonable grounds that a candidate or third party has contravened a provision of the Municipal Elections Act, 1996 relating to election campaign finances, may apply for a compliance audit of the candidate or third party campaign finances.

    To request a compliance audit of a municipal council candidate (Mayor or Councillor), an elector may submit a written request to the Clerk, 111 Erie Street North, Leamington, Ontario N8H 2Z9; phone (519) 326-5761. The request should include your name, address and contact information, the candidate’s name, and the reason for requesting a compliance audit with specific examples.

    An application for a compliance audit shall be made to the Clerk within 90 days after March 29, 2019, the financial filing date.

    To request a compliance audit of a school board candidate, the application should be sent to the Director of the appropriate school board.  Contact information is available on their website.

    Audit Process

    Within 30 days after receiving the application, the Compliance Audit Committee (or School Board) will consider the application and decide whether to grant it or reject it.  If granted, the committee will appoint an auditor to commence an audit of the candidate's election campaign finances to determine if the candidate complied with the provisions of the Municipal Elections Act, 1996.

    • The decision of the committee may be appealed to the Ontario Court of Justice within 15 days after the decision is made and the court may make any decision the Committee could have made.
    • Once the auditor has completed the audit, the auditor will provide a report to the Clerk, who forwards it to the committee, and to the candidate.
    • The Municipality pays the auditor's costs.
    The Committee will consider the report within 30 days of receiving it and determine whether legal proceeding should be commenced against the candidate.
    Candidate Financial Statements

    Candidates must file physical copies of their financial statements at the Clerk's Department at the Municipal Building located at 111 Erie Street North, Leamington during regular office hours. No electronic files are permitted. 

    Statements for Candidates for the 2018 Municipal Election are due on or before Friday, March 27, 2019 at 2 PM. Forms can be found on the Service Ontario website

    Third Party Advertisers

    The Municipal Elections Act, 1996 now includes rules for third party advertising. 

    A third party advertisement is an advertisement in any medium (broadcast, print, electronic or other medium) that has the purpose of promoting, supporting or opposing a candidate or a 'yes' or 'no' to a question on a ballot. 

    Third party advertising does not include:

    • an advertisement by and under the direction of a candidate;
    • where no expenses are incurred by a person/entity in relation to the advertisement (such as comments made on social media);
    • when given or transmitted by an individual to employees, by a corporation to its shareholders, directors, members or employees or by a trade union to its members or employees.

    A third party advertisement is an advertisement in any medium (broadcast, print, electronic or other medium) that has the purpose of promoting, supporting or opposing a candidate or a 'yes' or 'no' to a question on a ballot. 

    You must be registered as a Third Party Advertiser prior to the start of any advertising. 

     Who Can Register as a Third Party Advertiser?
      Only the following persons and entities are eligible to file a notice of registration:
    • an individual who is normally a resident in Ontario;
    • a corporation that carries on business in Ontario;
    • a trade union that holds bargaining rights for employees in Ontario.
      Who Cannot Register as a Third Party Advertiser?
      Persons and entities that are not eligible to file a notice of registration include:
    • a candidate whose nomination has been filed under section 33 of the Act;
    • a federal political party registered under the Canada Elections Act or any federal constituency association or registered candidate at a federal election endorsed by that party;
    • a provincial political party, constituency association, registered candidate or leadership contestant registered under the Election Finances Act;
    • The Crown in Right of Canada or Ontario, a municipality or local board.
    How to Register?
    An individual, corporation or trade union may register as a third party by filing a Notice of Registration at the Municipal Building, in the Municipality of Leamington, 111 Erie Street North, Leamington, Ontario during regular office hours, beginning Tuesday, May 1, 2018 at 8:30 AM. The Notice of Registration may not be faxed, mailed or emailed, as an original signature is required. 

    The individual filing the Notice of Registration will be required to present proof of identity as well as a declaration of qualification signed by the individual or by a representative of the corporation or trade union, as the case may be.
