    Compliance Audit Committee

    Compliance Audit Committee

The purpose of the Compliance Audit Committee is to receive and make decisions on applications for compliance audits of candidate and third party campaign finances in relation to a municipal election and any by-elections during Council's term pursuant to the Act. The powers and functions of the Committee are set out in section 88.33 to 88.37 of the Municipal Elections Act, 1996.

    Apply for a Compliance Audit

An eligible elector who believes that a candidate or registered third party advertiser has contravened the election campaign finance rules under the Municipal Elections Act, 1996, may apply for a compliance audit of their campaign finances.

To apply for a compliance audit of a councillor candidate, mayoral candidate, or registered third party advertiser:

    1. This application shall be in writing and shall set out the reasons for the elector's application.
    2. Submit the form and any supporting documents by the deadline (below) and email to clerks@leamington.ca.

Note:  To request a compliance audit of a school board candidate, the application should be sent to the Director of the appropriate school board. Contact information is available on their website.

The Clerk must receive the compliance audit application by the following dates:

    • For the initial financial filing deadline of March 31, 2023, the Clerk must receive the compliance audit application form by June 29, 2023.
    • For the supplementary financial filing deadline of September 29, 2023, the Clerk must receive the compliance audit application form by December 28, 2023.
    • For financial statements filed during the 30-day grace period or a court-ordered extension, the Clerk must receive the compliance audit application within 90 days of the extension filing date.
    • The Election Compliance Audit Committee will consider the application and, if granted, will appoint an auditor to audit the campaign finances. The Committee will consider the audit results and decide whether to commence legal action.

Please note that in addition to the compliance audit process, any person may pursue their own legal action in relation to the election. A prosecution related to the 2022 municipal election must be commenced on or before November 14, 2026.

    Audit Process

    • Within 30 days after receiving the application, the Election Compliance Audit Committee will consider the application and decide whether to grant it or reject it. If granted, the committee will appoint an auditor to commence an audit of the candidate's election campaign finances to determine if the candidate complied with the provisions of the Municipal Elections Act, 1996.
    • The decision of the committee may be appealed to the Ontario Court of Justice within 15 days after the decision is made and the court may make any decision the Committee could have made.
    • Once the auditor has completed the audit, the auditor will provide a report to the Clerk, who forwards it to the committee, and to the candidate.
    • The Municipality is responsible for the auditor's costs.
    • The committee will consider the report within 30 days of receiving it and determine whether legal proceeding should be commenced against the candidate.
