Leamington Council will hold a public meeting on Tuesday, June 24, at 6:00 PM to consider a Combined Official Plan Amendment (OPA) No. 31 and Zoning By-law Amendment (ZBA) No. 346 application at the Leamington Municipal Building, Council Chambers, 111 Erie Street North, Leamington, Ontario N8H 2Z9.

The purpose of OPA No. 31 is to change the language of the official plan to allow for Additional Residential Units to be permitted. It will also amend language concerning mixed-use developments to permit the zoning by-law to allow different forms of mixed-use development.

The purpose of ZBA No. 346 is to create a new subsection under Section 4 of the zoning by-law to regulate the development of Additional Residential Units. The amendment will also amend Subsection 4.1.1 to remove barriers to developing Additional Dwelling Units that were not intended under the original by-law. It will also add the required definitions for new terms created in the new subsection and those changed in existing subsections. The zoning amendment will also amend the site-specific R6-3 Zone to permit mixed-use development in addition to the uses already permitted. ZBA No. 346 will further amend the temporary zoning passed under ZBA No. 314 to allow the development to proceed without removing the holding zone provision.

If a person or public body would otherwise have an ability to appeal the decision of the Council of the Corporation if the Municipality of Leamington to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Municipality of Leamington before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Municipality of Leamington before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

If you wish to be notified of the decision of the Council of the Corporation of the Municipality of Leamington on the proposed ZBA, you must make a written request to the Clerk, Municipality of Leamington, 111 Erie Street North, ON N8H 2Z9, or clerks@leamington.ca.

Notwithstanding the above, Section 34(19) of the Planning Act defines the parties that are eligible to appeal the decision to the Ontario Land Tribunal.

If a person or public body would otherwise have an ability to appeal the decision of the County of Essex to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the County of Essex before the proposed official plan amendment is adopted, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the County of Essex before the proposed official plan amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

If you wish to be notified of the decision of the County of Essex on the proposed official plan amendment, you must make a written request to Rebecca Belanger, Manager of Planning Services, County of Essex, 360 Fairview Avenue, Essex, Ontario N8M 1Y6, or rbelanger@countyofessex.ca.

Notwithstanding the above, Subsection 17(36) of the Planning Act defines the parties that are eligible to appeal the decision to the Ontario Land Tribunal.

The meeting may be viewed in person at the Leamington Municipal Building or live online at leamington.ca/Live.

Additional information and material about the proposed official plan amendment and by-law will be available to the public for inspection when the Council Agenda is published before the hearing date and in person at the Municipal Building.
