Notice of Adoption and Passing of Combined OPA 33 and ZBA 347 at 923 Mersea Road 4
Leamington Council held a public meeting on October 28, 2025, for consideration of Zoning By-law Amendment (ZBA) No. 347 and Official Plan Amendment (OPA) No. 33. The applications were approved and By-law 89-25 to amend ZBA 890-90, as amended, was passed by Council.
The purpose and effect of the ZBA is to permit two (2) Off-site Farm Worker Dwellings with site-specific provisions, notably to increase the permitted Lot Coverage for 4% to 10% for all buildings, structures, vehicle/bicycle parking and driveways.
The purpose and effect of the OPA is to establish a site-specific Agricultural policy area to permit two (2) Off-site Farm Worker Dwellings.
Only individuals, corporations and public bodies may appeal a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
Notwithstanding the above, subsections 17(24) and 34(19) of the Planning Act defines the parties that are eligible to appeal the decision to the Ontario Land Tribunal.
