Notice of Complete Application and Public Meeting to Consider a Zoning By-law Amendment ZBA No. 244

Take notice that the Municipality of Leamington has received a complete Zoning By-law Amendment Application ZBA No. 244 to be considered by Council under the provisions of Section 34 of the Planning Act, R.S.O. 1990 c.P. 13.

And further that Council will hold a public meeting to consider the application which applies to the lands located at 357 Oak Street East.

 Time:              6:00 PM

 Location:        Electronic Meeting - Due to COVID-19 and restrictions on public gatherings, this meeting will be held in a virtual forum through electronic participation only. There will not be an in-person meeting.

The purpose of the application is to provide relief from Section 4.54 of Zoning By-law 890-09, as amended, to permit the temporary placement and use of two storage containers for a period not to exceed three years. Enbridge Gas requires the storage containers for the temporary storage of materials related to the construction and maintenance of gas lines to service the greenhouse industry. The location of the storage containers is shown on the attached site plan dated July 7, 2021. The placement of storage containers on the subject property is subject to site plan control approval.

Any person may make written and/or verbal comments either in support of or in opposition to the application(s). If you are an owner of property containing seven or more residential units, you are requested to post this notice in a location visible to all residents. 

Please note that if you wish to provide oral comments at the electronic meeting, you must register in advance by emailing clerks@leamington.ca or calling 519-326-5761 extension 1121 prior 12:00 PM on the date of the meeting. Once you register, you will be contacted by the Clerk’s Department and provided information on how to make your submission at the electronic meeting by electronic participation. To participate, you will need access to a computer or tablet with internet service or a telephone.

As an alternative to attending the meeting, written correspondence may be submitted to the Clerk no later than 12:00 PM on the date of the meeting. Please email clerks@leamington.ca or drop it in the Leamington Municipal Building mail slot located to the right of the rear entrance off of the parking lot. The Municipal Building is located at 111 Erie Street North, Leamington, Ontario, N8H 2Z9. Please note, written correspondence may be included on the agenda which will be published on the municipal website and will form part of the public record.

If you wish to be notified of the decision of The Corporation of the Municipality of Leamington on the proposed zoning by-law amendment, you must make a written request to the Clerk, Municipality of Leamington, 111 Erie Street North, Leamington, ON N8H 2Z9 or by email at clerks@leamington.ca.

If a person or public body would otherwise have an ability to appeal the decision of Council of The Corporation of the Municipality of Leamington to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submission to The Corporation of the Municipality of Leamington before the by-law is passed or refused, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Clerk of The Corporation of the Municipality of Leamington, before the by-law is passed or refused, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
