Notice of Passing of Zoning By-law Amendment No. 349 at 21 Robson Road

Leamington Council held a public meeting on Tuesday, June 24, 2025, to consider Zoning By-law Amendment (ZBA) No. 349. The application was approved, and By-law No. 59-25 to amend Zoning By-law 890-90, as amended, was passed by Leamington Council.

The purpose of ZBA No. 349 was to rezone 21 Robson Road from Commercial General (C6-8) Zone to Commercial General (C6-17) Zone to establish site-specific zoning provisions.

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

Notwithstanding the above, subsection 34(19) of the Planning Act defines the parties that are eligible to appeal the decision to the Ontario Land Tribunal.
