Take Notice that the Council of The Corporation of the Municipality of Leamington has passed By-law Number 78-21 on November 9, 2021 under Section 34 of the Planning Act, R.S.O. 1990.

And Take Notice that only individuals, corporations and public bodies may appeal a zoning by-law to the Ontario Land Tribunal.  A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

And Take Notice that no person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

Appeal to the Ontario Land Tribunal in respect of the by-law may be completed by filing with the Clerk of The Corporation of the Municipality of Leamington no later than December 6, 2021, a notice of appeal setting out the objection to the by-law and the reasons in support of the objection accompanied by the required fee of $1,100.00 (certified cheque or money order) made payable to the Minister of Finance. Upon receipt, the letter of appeal, a copy of the appeal form, which is available from the Ontario Land Tribunal website at www.olt.gov.on.ca, and other documents from the application file will be forwarded to the Ontario Land Tribunal.

Explanatory Note

The subject lands represent the retained lands of Consent Application B-19-21 which was a lot addition to add 0.528 ha (1.3 ac) of vacant land from 297 Erie Street South to the rear of abutting 310 Sherk Street. By-law Number 78-21 amends the site-specific zoning of the lands at 297 Erie Street South from Commercial Shopping Centre (C3-3) Zone to Commercial Shopping Centre (C3-8) Zone to reflect the resulting size of the retained parcel and existing structures. The following C3 provisions apply to the subject lands – Minimum Lot Area, Minimum Lot Frontage, Minimum Front Yard, Maximum Lot Coverage, Minimum Landscaped Open Space and Minimum Rear Yard. The existing provisions for Minimum Interior Side Yard of 4 m is maintained and the site-specific provisions recognize a Minimum of 1 Barrier Free Parking Space for the gross floor area of the existing use as a financial institution.  There are no changes proposed to the existing building or parking spaces on the property as a result of this amendment.
