Notice of Adoption and Passing of Combined OPA 28 and ZBA 322 at 88 & 92 Victoria Avenue South

Leamington Council held a public meeting on Tuesday, April 8, 2025, for consideration of Zoning By-law Amendment (ZBA) No. 322 and Official Plan Amendment (OPA) No. 28. The applications were approved, and By-law No. 33-25 to amend ZBA No. 890-90, as amended, and By-law No. 32-25 to amend the Official Plan was passed by Council.

The purpose and effect of ZBA No. 322 is to re-zone the subject lands from Commercial General Zone (C6) and Residential Zone (R2) to a site-specific Residential Zone (R3-24) to permit multi-unit residential dwellings. All provisions of the Multi-Unit Dwelling will apply except for the following exceptions:

  1. Reductions to the Minimum Interior Side Yard:
    • From 3 m to 2.40 m from the northern property line abutting 86 Victoria Avenue South;
    • From 3m to 1.80 m from the western property line abutting 86 Victoria Avenue South; and
    • From 3 m to 1.65 m from the southern property line abutting 33 Oak Street East;
  2. A reduction to the required Maximum Building Height from 10 m to 8.5 m;
  3. A reduction to the required Minimum Parking Space Width from 3 m x 6 m to 2.74 m to 6 m;
  4. A reduction to the required Minimum Off-Street Parking Spaces from 1.5 spaces per dwelling unit (for a total of 32 parking spaces) to a Minimum of 1.28 spaces per dwelling unit, with a maximum of twenty-seven (27) spaces;
  5. Establishing a set number of 2 Barrier Free Parking Spaces from the required Mimum of 2 of Barrier Free Parking Spaces; and
  6. Establish a Minimum of ten (10) Bicycle Parking Spaces.

The Purpose and effect of OPA No. 28 is to redesignate the portion of the subject lands from Uptown Commercial to Residential to permit a multi-unit residential development.

The proposed OPA will be submitted to the County of Essex (the approval authority) for approval. Any person or public body will be entitled to receive the proposed decision of the approval authority in respect of the proposed OPA if a written request to be notified of the proposed decision is made to the approval authority.
