Notice of Adoption and Passing of Combined OPA No. 29 and ZBA No. 334 111 Erie Street South
Take notice that Leamington Council held a public meeting on February 25, 2025, for consideration of Zoning By-law Amendment (ZBA) No. 334 and Official Plan Amendment (OPA) No. 29. The applications were approved, and By-law 15-25 to amend Zoning By-law 890-90, as amended, was passed by Council.
The purpose and effect of OPA No. 29 is to establish a special policy area to permit residential development. A copy of By-law No. 16-25 (OPA No. 29) adopting this Amendment is attached.
The purpose and effect of ZBA No. 334 is to establish site-specific zoning provisions within the Commercial Zone (C6-16) to permit residential uses and within the Residential Zone (R2-19) to permit a parking area supplementary to the residential development. A description of the lands to which the By-law applies and/or a key map showing the location of the lands to which the By-law applies are attached.
Submission To Approval Authority
The proposed Official Plan Amendment will be submitted to the County of Essex (the approval authority) for approval. Any person or public body will be entitled to receive the proposed decision of the approval authority in respect of the proposed Official Plan Amendment if a written request to be notified of the proposed decision is made to the approval authority. The address of the approval authority is the Corporation of the County of Essex, Attention: Mrs. Rebecca Belanger, Manager of Planning Services, 360 Fairview Avenue West, Essex, ON N8M 1Y6. And take further notice that with respect to the Zoning By-law Amendment, this decision is subject to appeal to the Ontario Land Tribunal e-file service or with the Planning Services office directly, before 4:30 PM on March 20, 2025.
Where no appeal, if within such 20 days, no notice of appeal is given, the decision of the committee is final and binding, and the municipal clerk shall notify the applicant and shall file a certified copy of the decision with the clerk of the municipality.
