Notice of Passing of ZBA 380 at Vacant Land Southwest of Bevel Line
Leamington Council held a public meeting on August 11, 2026 to consider Zoning By-law Amendment application (ZBA) #380. The application was approved, and By-law No. 76-26 to amend Zoning By-law 890-90, as amended, was passed by Leamington Council.
The purpose of ZBA 380 is to request relief from subsection 8.1.3 of the Leamington Zoning By-law 890-09, as amended, to permit an increase in the maximum lot coverage for single unit attached dwellings from 40% to 45% for interior units and from 50% to 55% for exterior units, and to permit a reduction in the minimum exterior side yard setback from 4.5 metres to 3.0 metres for Blocks 133 and 147 only.
Only individuals, corporations and public bodies may appeal a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
Notwithstanding the above, subsection 34(19) of the Planning Act defines the parties that are eligible to appeal the decision to the Ontario Land Tribunal.
