Notice of Public Meeting to consider ZBA No. 366 for Vacant Land, County Road 31

Leamington Council will hold a public meeting on Tuesday, January 27, 2026, at 6:00 PM to consider an application for Zoning By-law Amendment (ZBA) 366 at the Leamington Municipal Building, Council Chambers, 111 Erie Street North, Leamington, Ontario N8H 2Z9.

The purpose and effect of ZBA 366 is to rezone the subject property to a site-specific Commercial Industrial (C4-8) Zone to permit a Waste Transfer Station. It also seeks to establish an increased maximum height of 13 metres, and establish site-specific parking requirements requiring 60 total parking spaces, including the required barrier-free spaces. The rezoning will also recognize the approved Minor Variance (A-11-24), which reduced the required frontage to 20 metres, by making it part of the zoning provisions.

If a person or public body would otherwise have an ability to appeal the decision of Council for The Corporation of the Municipality of Leamington to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to The Corporation of the Municipality of Leamington before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to The Corporation of the Municipality of Leamington before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Notwithstanding the above, subsection 34(19) of the Planning Act defines the parties that are eligible to appeal the decision to the Ontario Land Tribunal.

The meeting may be viewed in person at the Leamington Municipal Building or live online at leamington.ca/live.

Additional information and material about the proposed by-law will be available to the public for review when the Council Agenda is published before the hearing date and in person at the Municipal Building.
