Liquor Licensing

To serve and/or sell alcohol in the Municipality of Leamington, you will need a liquor licence/permit from the Alcohol Gaming Commission of Ontario (AGCO). Certain licence types require that you provide written notice to the Clerk and in addition, you are sometimes required to get municipal clearance or approvals from Building Services and Fire Services at the Municipality of Leamington.

As part of a liquor sales licence approval, the AGCO will require you to provide a Municipal Information Form signed by the Municipal Clerk and Agency Letters of Approval from Building Services, Fire Services and the Windsor-Essex County Health Unit.

The following documents and applicable fees are to be submitted to the Customer Service Counter (Legislative Services) at the Municipal Building located at 111 Erie Street North.

Legislative Services will circulate the Agency Letter of Approval, floor plan and any other relevant documents to Building Services and Fire Services on your behalf. 

As the Applicant, you are responsible for submitting an Agency Letter of Approval to the Windsor-Essex County Health Unit

Once all reviews have been completed successfully, you will be contacted to pick-up the signed letters. As the Applicant, you are responsible for submitting the signed Municipal Information Form and Agency Letters of Approval to the AGCO through the iAGCO portal.

Special Occasion Permits (Public and Private Events)

A Special Occasion Permit (SOP) is required any time alcohol is offered for sale anywhere other than in a licensed establishment. Permit applications must be submitted at least 30 days prior to the event. A permit may be issued for Private and Public Events.

The Municipality of Leamington owns and manages facilities where alcohol consumption is not permitted and other facilities where alcohol consumption is permitted under the authority of a Special Occasion Permit. The Municipality of Leamington has developed an Alcohol Risk Management Policy in order to prevent alcohol related problems that arise from alcohol consumption within its facilities, and to promote a safe, enjoyable environment for those who use these facilities. 

For events where only invited guests will attend (example: weddings). These events are not to be advertised and there can be no intent to gain or profit from the sale of alcohol at the event.

For private events held outdoors, the Municipal Clerk, Building Services, Fire Services and the Leamington O.P.P. are to be provided written notice at least 30 days prior to the event. As the applicant, you are responsible for submitting written notice to the Leamington O.P.P. They can be reached at 519-326-2544.

Notice is to be provided in separate letters to the Municipal Clerk, Building Services and Fire Services. All letters are to be submitted at the Customer Service Counter (Legislative Services) at the Municipal Building located at 111 Erie Street North and should include the following:

  • The addressee (Municipal Clerk, Building Services, Fire Services);
  • Event name, location, date(s) and start and end time(s);
  • Name and contact information of the event organizer;
  • Expected daily attendance;
  • Statement that the event is private and whether it will be held indoors and/or outdoors;
  • A note if there is a tent, marquee, pavilion or tiered seating being used. 
  • Please note, a $25.00 (Clerk's Legislative Services) fee is due upon application.

For events that are open to the public. Public events can be advertised and allow for fundraising/profit from the sale of alcohol.

For any public events, indoors or outdoors, the Municipal Clerk is to be provided with written notice at least 30 days prior to the event. Written notice to the Municipal Clerk should include the following:

  • Be addressed to the Municipal Clerk;
  • Event name, location, date(s) and start and end time(s);
  • Name and contact information of the event organizer;
  • Expected daily attendance;
  • Statement that the event is public and whether it will be held indoors and/or outdoors;
  • A request for the event to be deemed "municipally significant".

Upon successful review, the Municipal Clerk will prepare a "Letter of Non-Objection" deeming the event "municipally significant" which you are to submit to the AGCO through the iAGCO portal.

Effective January 1, 2023 The Municipality of Leamington processes and approves temporary outdoor liquor licence extensions (temporary patios) of liquor licensed premises. Temporary patios may be approved for up to a maximum of 8 months per calendar year. Applicants are still responsible for notifying the AGCO about their approval, the duration and any conditions on the approval.

Municipal Property

Temporary extensions on municipal property are also known as "sidewalk patios". 

Engineering Services oversees patios on municipal property. Applicants must complete the Municipality's Temporary Sidewalk Patio Application and comply with the Sidewalk Patio By-law and Guidelines. 

Once approved by Engineering Services, should the applicant intend to serve alcohol on the proposed patio they will be required to complete the Application for Temporary Outdoor Liquor Licence Extension.

Private Property

There are two types of private property temporary extensions. 

1. Special Event (3 days maximum) 

Application for Temporary Outdoor Liquor Licence Extension, applicants must upload the following information to the application: 

- Site Sketch (show location including any proposed port-a-john locations)

- Copy of valid liquor licence

Application will be circulated to the Municipal Clerk, Building Services, and Fire Services for review and approval.

2. Non-Special Event (8 months maximum) 

Used for businesses that want to add a temporary patio for summer and is not located on municipal property. 

Application for Temporary Outdoor Liquor Licence Extension, applicants must upload the following information to the application: 

- Site Sketch (must meet the Site Plan Drawing Requirements per Planning Services)

- Copy of valid liquor licence

Application will be circulated to the Municipal Clerk, Building Services, Fire Services, and Planning Services for review and approval.
